Terms of Service

This document is an English translation of an original document in Japanese. If there is any discrepancy between this translation and the original document, the latter shall prevail legally.

These terms and conditions of use (hereinafter referred to as the "Terms and Conditions") set forth the terms and conditions of use for the services provided by the website administrator (hereinafter referred to as the "Administrator") on this website (hereinafter referred to as the "Service"). Users are requested to use the Service by these Terms of Service.

1. Adoption

3. Acts that destroy or interfere with the functioning of the servers or networks of the Administrator, other users of the service, or third parties.
4. Acts that may interfere with the operation of the Administrator's services.
5. Actions that collect or accumulate personal information, etc., regarding other users.
6. Acts of gaining or attempting to gain unauthorized access.
7. Act to impersonate other users.
8. Act to provide benefits directly or indirectly to antisocial forces about the services provided by the Administrator.
9. Infringing the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Administrator, other users of the service, or third parties.
10. Posting or transmitting content on the Service that includes or is deemed by the Administrator to include any of the following expressions.
    • Excessively violent expressions.
    • Explicit sexual expressions.
    • Discrimination based on race, nationality, creed, sex, social status, family origin, etc.
    • Expression that induces or encourages suicide, self-injury, or drug abuse.
    • Other expressions that include antisocial content and cause discomfort to others.
11. Any activity that the Administrator determines to be for or to.
    • Sales, promotion, advertisement, solicitation, or other for-profit activities (except those approved by the Administrator).
    • Acts for sexual or obscene acts.
    • Actions for meeting or dating an unacquainted person of the opposite sex.
    • Actions aimed at harassing or slandering other users.
    • Intentionally pretending to be truthful when you know it is not.
    • Actions that aim to cause disadvantage, damage, or discomfort to the Administrator, other users of the Service, or third parties.
    • Any other act of using the Service for a purpose that differs from the intended purpose of use of the Service.
12. Religious activities or solicitation of religious organizations.
13. Other activities that the Administrator deems inappropriate.

3. Suspension, etc., of the Provision of this Service

1. The Administrator reserves the right to suspend or discontinue all or part of the Service without prior notice to the User for the following reasons.
   • When performing maintenance inspections or updating computer systems related to this service.
   • Providing this service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outage, or natural disasters.
   • When computers or communication lines are shut down due to an accident.
   • In addition, if the administrator deems it challenging to provide the Service.
2. The administrator shall not be liable for any disadvantage or damage incurred by the user or any third party due to the suspension or interruption of the provision of the Service.

4. Copyright

1. Users may only use the Service to post or upload text, images, videos, and other information for which they own the necessary intellectual property rights, such as copyrights, or have obtained permission from the necessary right holders.
2. The copyrights of any text, images, videos, etc., posted or uploaded by users using the Service shall be reserved for the users concerned or other existing right holders. However, the administrator may use the text, images, videos, etc., posted or uploaded using the Service to the extent necessary to improve the Service, enhance its quality, correct any inadequacies, or publicize the Service. The User shall not exercise moral rights in connection with such use.
3. Except as provided in the preceding paragraph, all copyrights and other intellectual property rights to the Service and all information related to the Service shall belong to the administrator or to the right holders who have authorized the administrator to use them. Users shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or commercially use without permission.

5. Restrictions on Use and Cancellation of Registration

1. The administrator will delete the posted data and restrict the user from using all or part of the Service without prior notice if the user falls into the following cases.
   • If any of the provisions of these Terms of Service are violated.
   • If the administrator does not receive a response from the user for a certain period.
   • In addition, if the administrator deems this service's use inappropriate.
2. Suppose any of the items of the preceding paragraph applies. In that case, the User shall naturally lose the benefit of time concerning all debts owed to the administrator and shall immediately repay all debts owed to the administrator in a lump sum.
3. According to this Article, the administrator shall not be liable for any damages incurred by the user due to any action taken by the administrator.

6. Disclaimer of Warranty and Disclaimer of Liability

1. The administrator makes no warranty, express or implied, that the service will be free from defects in fact or law (including any defects, errors or bugs, or infringements of rights concerning safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, etc.)
2. The administrator shall not be liable for any damages incurred by the user due to the Service. However, this disclaimer shall not apply if the contract between the administrator and the user concerning the Service (including this Agreement) constitutes a consumer contract as defined in the Consumer Contract Act.
3. Even in the case of the proviso of the preceding paragraph, the administrator shall not be liable for any damage to the user caused by the administrator's negligent default or tortious act caused by extraordinary circumstances. (This includes cases where the administrator or the user foresaw or could have foreseen the occurrence of damages.)
4. The administrator shall not be liable for any transactions, communications, or disputes between the user and other users or third parties in connection with the service.

7. Changes in service content, etc.

The administrator may change, add, or discontinue the Service with prior notice to the User, and the User agrees to such changes, additions, or discontinuation.

8. Changes to Terms of Service

1. The administrator may modify these Terms and Conditions as necessary, which shall become effective when posted on this website.
2. However, suppose the administrator changes these Terms and Conditions that require the user's consent under the law. In that case, the changed Terms and Conditions shall apply only to the user who has consented to the changes in the manner prescribed by the administrator.
3. Suppose the administrator decides to change the Terms of Service. In that case, the administrator will notify the user of the effective date and content of the revised Terms of Service by displaying the revised Terms of Service on the administrator's website or by any other appropriate means.

9. Handling of Personal Data

The administrator shall adequately handle personal information obtained through the Service by the "Privacy Policy".

10. Notification or contact

Notices or communications between a user and the administrator shall be made as determined by the administrator. Unless a user notifies the administrator of a change in the user's contact information by a method determined separately, the administrator will assume that the currently registered contact information is valid and will send notices or communications to that contact information. Such notifications or communications will be deemed to have reached the user when sent.

11. Prohibition of transfer of rights and obligations

The User may not assign its position under the Subscriber Agreement or its rights or obligations under these Terms and Conditions to any third party or offer them as security without the administrator's prior written consent.

12. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed by the laws of Japan.
In any dispute regarding this service, the court having jurisdiction over the administrator's location shall have exclusive jurisdiction.
